In most cases abbreviations have been expanded without comment to avoid confusion. A new page numbering system is used based on the microfilm frame order. Ince's original page numbers and the DLSL photocopy reference are given in red brackets. The original pages are held at DLSL, are separated, and unfortunately do not possess a coherent numbering system.

Back to MENU Transcribed by John Palmer, Dorset, England Copy of the Evidences left for me T N Ince by W Ja TOPLES of London July 28 1829 Affidavit on a 2/6 stamp - William SHILTON the Parish Clerk of Burton on Trent in the County of Stafford maketh oath and saith that there is a tombstone in the church yard of the parish church of Burton on Trent in the County of Stafford on which there are the following inscriptions "In memory of Hannah wife of William TOPLIS who died January 24th 1763 aged 48 . Also of Sarah and Mary their daughters. Sarah died June 9th 1747 aged 4 years. Mary died July 15th 1761 aged 7 years" And this deponent further saith that the said tombstone was standing in the said church yard on the twenty fifth day of November last. And that the said stone hath been there for many years. Sworn at Burton upon Trent in the County of Stafford this first day of March one thousand eight hundred and twenty seven. TOPLIS I am this morning in possession of your favour of the 22nd instant, enclosing the original case & opinion of 1743 on Mr TOPLIS' Marr. settlement, for which I am obliged - I was at Derby yesterday & found amongst Miss TAYLOR's Deeds an attested Copy of the marriage settlement and other documents shewing that the marriage was solemnized, but nothing to shew when - I also found that the original settlement was in the year 1758 given up to the Revd Sir John MOSLEY, an ancestor of the present Sir O.MOSLEY - Mr I H MOUSLEY, Sir O MOSELY's Solicitor, will next week search for the settlement & make me an attested copy of it - I also found evidence on the Court Rolls for the manor of Rolleston, which are in the possession of Mr John H MOSELY, to shew [continued on page 091c]

Back to MENU Transcribed by John Palmer, Dorset, England [continued from page 091b] that Mr TOPLIS married _Hannah_ ABRAHAM, for her Xtian name was Hannah and not Ann as stated in your sketch of the Pedigree of Mr TOPLIS I see how you have made the mistake - she is called "Ann" in the description of the parties to the Deed of Settlement set forth in the case, but in every other instance, throughout the case , she is called "Hannah" and she is called "Hannah" in the attested copy settlement in the possession of Miss TAYLOR - so that she is properly named in the tombstone in Burton churchyard - It is now useless your searching further for the copy marriage settlement - I wish you would inform me, by return of post, who it was that shewed you Mr TOPLIS's proofs in 1829 including the affidavit as to the Tombstone in Burton Church yard - I presume you have not those proofs now in your possession - Did Mr TOPLIS, himself, shew them to you? or who else? Back to MENU Transcribed by John Palmer, Dorset, England [This Pedigree is split between page 92c (left hand side) and 84d (right hand side)] Pedigree of [^ TOPLIS] of Brassington Co Derby drawn up by Thomas Norris INCE from an Abstract of Title, Brassington register, church yard notes, information derived from old Mrs TOPLIS aged upwards of 80, Mrs ATHERTON, James TOPLIS of Brassington, and others. In 1620 or a little later Thomas TOPLIS paid a composition after the rate of 9/- [9 shillings] a year to the Crown for the confirmation of his Copyhold estate there. This Thomas was undoubtedly the ancestor of the William at the head of the underwritten pedigree. Thirty five years rent as composition.

The name of TOPLEYS, TOPLISS, TOPLISSE, or as now spelt TOPLIS is of ancient standing in Derbyshire. The name is to be found of long standing at Tissington, Brassington, Kirk Ireton, Ashleyhay Wirksworth &c. The ancestors of this family as I presume were copyholders of the manor of Alderwasley & Ashleyhay in or before the reign of Queen Elizabeth. The name is however very ancient for I find Thomas TOPPELEYSE was Member of Parliament for Derby 1382 the first parliament of Richard 2nd. Ellen da of William TOPLEYS of Tissington Co Derby mard Richard BATEMAN of Hartington who was living 1561 & was father by her of Robert BATEMAN esq Merchant of London sometime MP & Chamberlain thereof he died 1644 & of several other sons one of whom Hugh BATEMAN was direct ancestor of the late Sir Hugh BATEMAN Bart of Hartington Hall Co Derby.
